Terms and conditions

VENTURE SAILING CONDITIONS OF BOOKING

Booking Conditions. No booking will be final until the correct Booking Form has been completed and received by Venture Sailing Sailing School together with the first payment at which time evidence of Contract is established.

Payment. The deposit is non-refundable in the event of cancellation. Final balance is due 8 weeks before departure. In the event of final payment being late Venture Sailing Sailing School reserve the right to accept a booking from a standby list. In this case all payments except the deposit will be refunded.

Amendments to Booking. Any alteration to this booking must be made to the office and then confirmed in writing. If acceptable it will be actioned once written confirmation has been received providing a suitable alternative Course is available.

Sailing. In the interest of safety Venture Sailing Sailing School Instructors have complete discretion over sailing activities taking into consideration weather conditions and their assessment of the students’ abilities. The student accepts the Instructors decision as final.

Yachts. All sailing and cruising facilities are subject to availability. The Company cannot be held responsible for the loss of the use of a yacht due to adverse weather conditions.

Cancellations.In the event of any cancellation more than 28 days before the commencement date any monies except for the first deposit will be refunded. A cancellation less than 28 days before the commencement of the Course will attract no refund. Venture Sailing Sailing School reserve the right to cancel a Course at any time. If we do so we shall return all monies paid by you to us in respect of the provision of the Course.

If you have a complaint. Our aim is to provide you with an enjoyable trouble-free Course. If you have a problem or complaint it is important and in your own interest to advise the Instructor and School Principal immediately so that steps can be taken to resolve the matter. If the matter cannot be resolved during the Course please notify us in writing within 28 days of your return to the UK. We will not consider any complaint unless notified to us at the time and in writing within 28 days.

Variation of Conditions. No variation in these Conditions or otherwise in the terms upon which an Instructional Course is booked and promised to refund money paid to the Company shall be valid unless in writing and signed by a Partner of Venture Sailing Sailing School.

Alterations. All information given by Venture Sailing Sailing School is provided in good faith but we reserve the right to provide alternative comparable arrangements if for any reason we decide alterations are necessary. If we have to cancel a Course our students will have the option of accepting any alternative period on offer or having a full refund of all monies paid. In that event our liability shall wholly cease upon the repayment of such monies.

Equipment. All yachts used by Venture Sailing Sailing School are fully equipped and regularly inspected by the relevant National Authorities and are considered suitable for use as sail training vessels.

General. You are solely responsible for complying with all Laws, Regulations, Orders, Demands and Requirements of the country in which your Course will be provided. We shall not be liable in any way whatsoever to you in connection with obtaining necessary documents or complying with such Laws, Regulations, Orders, Demands and Requirements or Instructions whether given orally or in writing or otherwise or for the consequences to you resulting from the failure to obtain such documents or to comply with such Laws, Regulations, Orders, Demands, Requirements or Instructions.

Conduct Aboard School Vessels. If in our reasonable opinion you conduct yourself aboard one of our school vessels so as to endanger the vessel or any person or property on board or behave in a disorderly manner or in a manner to which other clients may reasonably object we may take such measures as we deem necessary to prevent continuation of such conduct including your removal from the vessel. You may be prosecuted for offences committed on board a vessel. You agree to abide by the orders of the Instructor in command of the School vessel at all times.

Failing or Passing Courses. You will be assessed by an Instructor and/or Examiner during the Course. At the end of the Course they will decide if you have passed or failed. Their decision is final. If however you disagree with their decision you can make an application to the Royal Yachting Association for re-dress in the form required by that organisation.

Injury and Death. We hereby make you aware that sailing is potentially a dangerous activity and we cannot be held responsible for any injury or death during one of our Courses save for our responsibilities. Venture Sailing Sailing School hold Public Liability Insurance up to a maximum of £3m.

Personal Insurance. Personal belongings should be covered by the individual’s personal/travel insurance. Venture Sailing Sailing School do not accept any responsibility for loss/damage to personal belongings whilst on board the School Yacht.

Travel Documents. You are responsible for obtaining and must possess and have available for presentation as required all entry and exit health and other documents required by Laws, Regulations, Orders, Demands or Requirements of the country in which your Course will be provided. We reserve the right to provide a Course to anyone who has not complied with or whose documents do not appear to comply with such applicable Laws, Regulations, Orders, Demands or Requirements.

Accommodation on Board. Accommodation is provided for the five nights during the RYA Course. Two additional night’s accommodation on board the School vessel are offered free at the discretion of Venture Sailing Sailing School. It is understood that students accept total responsibility for their safety whilst on board during the non-Course days. Venture Sailing Sailing School has sole discretion to withdraw this additional accommodation at any time. Under these circumstances Venture Sailing Sailing School will arrange shore-side accommodation at a maximum cost to the student of 30 Euros per night. The yacht must be vacated on non-School days by 9am to facilitate servicing and general maintenance.

The Possibility of Failure Although our track record is well established, the possibility of failure and danger is by our definition implicit in an expedition. Otherwise it would not be an adventure!

Therefore we can give no guarantees that any expedition or group will reach its objectives. We will make our best efforts to stick to a client’s itinerary as agreed beforehand, but the possibility of modifications because of: weather, the limitations of a small sailing vessel and the skipper’s final say on decisions affecting safety, amongst other factors, must be accepted by the client.
